DAVIDSON COUNTY, Tenn. (WKRN) — Two men are in Immigration and Customs Enforcement custody after getting into a minor car accident with law enforcement in Davidson County.

Oliver Bustamante-Ruiz and his brother Justyn Bustamante are both in the United States illegally from Mexico. They were on their way to work when they rear ended a U.S. Marshal.

The Marshals Service called immigration officers to the scene.

The Department of Homeland Security confirms they're in custody.

"Having to go on these next few days wondering where they are is traumatizing," the men's nephew, Charlie Bustamante, said.

The men were heading to work on Tuesday morning on Smith Springs Road near Percy Priest Lake.

Officers said Justyn was behind the wheel and rear-ended a U.S. Marshal who was driving a black truck.

"There was almost stunning fear to where you can't even move or speak," Charlie said.

Jason Emerton is Oliver's fiancé. He said they'd hoped for a bright future together, but Oliver's immigration status was never far from their mind.

"We've seen it happening all around us," Emerton said. "I just never thought it would be a problem that we would have to face."

Right now, the family's waiting anxiously to find out more. They said Oliver and Justyn don't have criminal backgrounds.

State troopers said they're only investigating the car crash. They said they didn't play a role in detaining anyone during this investigation due to immigration status.
