NASHVILLE, Tenn. (WKRN) — A man on death row in Tennessee has selected his last meal before his execution later this week.

Oscar Smith is scheduled is to die by lethal injection on Thursday, May 22, making him the first prisoner to be executed under the state's new protocol.

Smith was convicted of fatally stabbing and shooting his estranged wife, Judith Smith, and her two sons, Jason and Chad Burnett, at their Nashville home on Oct. 1, 1989.

According to the Tennessee Department of Correction, Smith has requested hot dogs, tater tots and an apple pie with vanilla ice cream for his final meal.

However, this isn't the prisoner's first time making a last meal request. In 2022, Smith was served a double cheeseburger, a deep dish apple pie and vanilla bean ice cream as his final meal before his scheduled execution.

Hours before the planned execution, Tennessee Gov. Bill Lee announced the execution would be delayed due to an issue with the injection.

Under the new execution protocol, the state will utilize the single drug pentobarbital. After the protocol's revision was complete, TDOC announced the execution dates of several inmates with News 2:

• Oscar Smith, who was found guilty of killing his estranged wife Judith in 1989, has a execution date of May 22, 2025
• Byron Black, who was convicted of three counts of first-degree murder in connection with the homicides of Angela Clay and her two daughters, has a new execution date of Aug. 5, 2025
• Donald Middlebrooks, who was convicted for the 1987 murder of Kerrick Majors, has a new execution date of Sept. 24, 2025
• Harold Nichols, who was convicted of rape and first-degree murder in the death of 21-year-old Karen Pulley, has a new execution date of Dec. 11, 2025

Inmates whose crimes were committed before Jan. 1, 1999, can choose between the lethal injection and the electric chair under Tennessee law.
