SUMNER COUNTY, Tenn. (WKRN) — A man is facing a homicide charge in connection with a shooting involving a relative in Sumner County earlier this week.
According to the affidavit, the Sumner County Emergency Communications Center got a 911 call at approximately 8 p.m. on Tuesday, Oct. 21, from a man saying his brother, James Purnell Brinkley Sr., jumped his cousin, Kenneth Phillips, who then shot Brinkley.
Deputies responded to the scene, located in the 1000 block of Rogana Road in Bethpage, and found Brinkley inside the shop with a gunshot wound to the left side of the chest, the back right shoulder and the upper buttocks, per the court documents. Law enforcement reportedly performed life-saving measures until Sumner County EMS arrived, but Brinkley was pronounced dead shortly after 8:30 p.m.
Based on the affidavit, the 911 caller said Brinkley — who was intoxicated — and his other brother were at his house in the 1200 block of Rogana Road when Phillips stopped by, leading to an argument between Brinkley and Phillips.
Brinkley's brother reported Phillips drove back to his home in the 1000 block of Rogana Road, according to the court documents. After that, the caller allegedly received some messages from Brinkley's girlfriend, who said she believed Brinkley was going to hang himself.
Per the affidavit, Brinkley's brother replied to the messages, saying, "he just started something with Kenny and he has a tooth that is absest" and "He going to Kenny's to kill him if he goes up he will go to jail or will shoot bubba."
The caller said another man stopped by his home and told him Brinkley and Phillips were in a fight, and he believed Brinkley may have broken the other man's leg, based on the court documents. Then, Brinkley's brother got a call from Phillips, who reportedly said, "I've just shot James in the butt."
The 911 caller drove to the 1000 block of Rogana Road and saw Phillips standing outside a shop located on the property, according to the affidavit. Brinkley's brother said he went into the shop, saw James, called 911, and started checking for a pulse until law enforcement and first responders arrived.
Per the court documents, the property owner reported he also received a call from Phillips saying he had shot Brinkley, but the owner didn't think much of it at the time.
Based on the affidavit, Phillips told detectives he got into an altercation with Brinkley at the brother's house. Phillips said he told Brinkley he needed to quit drinking and take care of his children, which upset Brinkley enough that he allegedly tried coming after Phillips through the window of his pickup truck.
About 30 minutes after Phillips left the residence, he reportedly heard someone walking into his shop while he was working under the hood of his truck. Then, Phillips said Brinkley put him in a headlock, the two fell to the ground, and Phillips went to the shop's office area to grab his .22 caliber rifle, according to the court documents.
"Kenneth stated he did not have great vision but believed he saw James near the front of the truck. Kenneth stated he shot 'a warning shot' and stated he observed it hit James in the chest," the affidavit says. "Kenneth stated he only remembers firing maybe two shots but could not recall where the other shot could have hit James. Kenneth also stated he never left the threshold of the office doorway."

After collecting three shell casings that matched Phillips' gun around the vehicle, authorities said it appears he fired two shots from across the back of the truck, went to the other side, and shot one more round.
Per the court documents, Phillips — who has no prior felony convictions — was arrested Tuesday for criminal homicide. The 53-year-old has a pre-trial bond of $1.6 million and a court date scheduled for Nov. 5.
